Articles 17-20: Zoning Bylaw changes

Changes to Acton’s Zoning By-Laws require a 2/3rds majority by Town Meeting voters. The moderator called for votes by clicker and the following Zoning By-Law changes were approved:

Article 17: Establish Nagog Park Innovation Overlay District

Acton adopted a Strategic Economic Development Action Plan in 2025 to encourage retention and expansion of manufacturing; improve environmental performance; improve building and site design; and promote outdoor spaces. The Nagog Overlay District implements these goals by supporting economic reinvestment, improving building and site design, promoting sustainability goals and protecting nearby residential areas.

Representatives from the Economic Development Committee spoke in support of the article. Residents opposed cited environmental concerns and the adverse effect on the adjacent neighborhood. The vote tally was 236 to 18.

Article 18: Promote Economic Development

Article 18 proposed targeted updates to the Zoning By-Law to better support local businesses and encourage reinvestment, by implementing recommendations from Acton’s Strategic Economic Development Action Plan. Included are changes to signage regulations; uses allowed in industrial, business and office districts; special permits requirements for commercial businesses and restaurants; and reduced open space requirements, among others.

Representatives from the Economic Development Committee spoke in support of the article. Residents opposed expressed concern about increased impervious areas and storm water runoff. Voters approved by a clicker count of 209 – 22.

Article 19: Residential additions on Non-Conforming Lots

The Article updates the Zoning By-Law to make it easier for homeowners on nonconforming lots to improve their homes. It reduces regulatory burdens, lowers costs, and prevents unnecessary delays for homeowners while keeping development consistent with existing neighborhood patterns.

No comments were heard. Voters approved by a clicker count of 191 to 16.

Article 20: Increase Affordability Requirements in the MBTA Overlay District

Voters approved a motion to take no action, based on the recommendation by the Select Board that the Article was premature. The vote to take no action passed 220 – 48.

Article 21: Related to Accessory Dwelling Units

Article 21 was included on the consent agenda, and passed as part of the consent package without discussion. Article 21 proposed a minor change in wording of Acton’s Accessory Dwelling Unit bylaw to bring Acton’s wording into compliance with new state law, the Affordable Homes Act.
